Terms & Conditions of Sale and Website Use

These Terms & Conditions (“Terms”) govern your access to and use of the Forti SecureStore website (the “Site”) and the purchase of products and services from Forti SecureStore (“Forti SecureStore”, “we”, “us”, “our”).
Forti SecureStore is an Australian authorised reseller of cybersecurity products and solutions, including Fortinet technologies, and operates as a business-to-business (B2B) provider unless otherwise stated.
By accessing the Site or placing an order, you agree to be bound by these Terms.
1. About Forti SecureStore
Forti SecureStore supplies cybersecurity hardware, software licences, subscriptions and associated services to Australian businesses and government entities. We are an authorised reseller of various cybersecurity vendors.
Nothing on this Site constitutes a binding offer to sell. All orders are subject to acceptance by us.
2. Changes to These Terms
We may amend these Terms at any time by publishing an updated version on the Site. The version in effect at the time of your order applies to that order.
Continued use of the Site following any update constitutes acceptance of the revised Terms.
3. Use of the Website
You agree that you will not:

Use the Site for unlawful purposes

Attempt to interfere with Site functionality or security

Reproduce, copy, modify or distribute Site content without written permission

Misrepresent your identity or purchasing authority
We reserve the right to suspend or restrict access where misuse is suspected.
4. Intellectual Property
All content on the Site — including text, graphics, branding, logos, images, layout and software — is owned by or licensed to Forti SecureStore and is protected under Australian intellectual property law.
Third-party trademarks (including vendor marks such as Fortinet) remain the property of their respective owners and are used under authorisation or reseller rights.
Nothing in these Terms grants you any intellectual property rights in the Site or its content.
5. Account Registration
Where you create an account:

You must provide accurate and complete information

You are responsible for maintaining confidentiality of login credentials

You are responsible for all activity under your account
We may suspend or terminate accounts where fraudulent or unauthorised activity is detected.
6. Pricing
All prices:
- Are in Australian Dollars (AUD) unless otherwise stated;
- Are indicative only and subject to change without notice prior to order acceptance;
- May fluctuate due to factors including vendor pricing, supply availability, licensing terms, distributor adjustments, and foreign exchange movements.
We make reasonable efforts to ensure pricing accuracy; however, pricing errors, inaccuracies, or omissions may occur. Where an incorrect price is displayed or quoted, or where a price is affected by vendor, distributor, or currency changes beyond our control, we reserve the right (at our sole discretion) to correct the price, amend the quote, refuse or cancel any order, or withdraw the offer, whether or not the order has been acknowledged or payment requested.
No contract is formed unless and until an order or quote is expressly accepted by us in writing.
7. Order Acceptance
An order confirmation email does not constitute acceptance of your order.
An order is only accepted when:

We issue a formal tax invoice; or

The goods are dispatched; or
-
A vendor licence/subscription is provisioned.
We reserve the right to decline or cancel any order, including due to:

Pricing errors
-
Vendor supply constraints
-
Credit approval issues
-
Suspected fraud
If payment has been processed for a cancelled order, we will refund the amount paid.
8. Payment Terms
We accept payment via:

Credit card (Visa, Mastercard, American Express). An additional merchant fee will apply
- Bank Transfer
9. Taxes
You are responsible for all applicable taxes, duties and charges associated with your purchase, including GST where applicable.
We will apply GST in accordance with Australian tax law.
10. Delivery and Risk
Delivery times are estimates only.
Title and risk in goods pass to you:

Upon delivery to the nominated address; or
-
Upon collection; or
-
Upon transfer to your nominated carrier.
For digital licences and subscriptions, risk passes upon provisioning to the nominated account or email.
We are not responsible for delays caused by:

Vendor stock shortages
-
Import delays
-
Carrier disruptions
-
Force majeure events
11. Returns and Change of Mind
Because cybersecurity hardware, software licences and subscriptions are often vendor-locked or non-returnable:

Change-of-mind returns are generally not accepted.

Software licences and subscriptions are non-refundable once provisioned.

Hardware returns are subject to vendor return authorisation policies.
Any approved return must:

Be requested within 7 days of delivery
-
Be unused and in original packaging
-
Include all accessories and documentation
Restocking fees may apply where permitted by law.
Nothing in this clause excludes your rights under the Australian Consumer Law (ACL).
12. Australian Consumer Law
Where you are a “consumer” within the meaning of the Australian Consumer Law:

Our goods come with guarantees that cannot be excluded under the ACL.

You are entitled to a replacement or refund for a major failure.
-
You are entitled to compensation for other reasonably foreseeable loss or damage.
Where goods are not ordinarily acquired for personal, domestic or household use, our liability is limited (at our option) to:

Replacement of the goods

Repair of the goods
-
Payment of the cost of replacement
-
Payment of the cost of repair
To the extent permitted by law.
13. Vendor Warranties and Support
All manufacturer warranties are provided directly by the relevant vendor.
Forti SecureStore does not provide independent product performance warranties unless expressly stated in writing.
Technical support for vendor products must be requested in accordance with the relevant vendor’s support terms and subscription level.
14. Limitation of Liability
To the maximum extent permitted by law:

We are not liable for indirect, consequential, incidental, punitive or special damages.

We are not liable for loss of profits, revenue, business interruption or data loss.

Our total aggregate liability for any claim relating to a product or service is limited to the amount paid for that product or service.
Nothing in these Terms excludes liability for:

Fraud
-
Death or personal injury caused by negligence

Non-excludable statutory guarantees
15. Indemnity
You agree to indemnify and hold harmless Forti SecureStore, its directors, employees and contractors against any claims, losses or damages arising from:

Your misuse of the Site

Your breach of these Terms
-
Your breach of any applicable law
16. Promotions
Promotions:

May be changed or withdrawn at any time

Cannot be combined unless expressly stated

Apply only to qualifying products
Free promotional items must be returned if the qualifying product is returned.
17. Leasing and Finance
From time to time, we may offer access to third-party leasing or financing options.
All financing arrangements are:

Subject to third-party approval
-
Governed by the financier’s own terms
-
Independent of Forti SecureStore
We do not guarantee finance approval.
18. Privacy
Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
We collect information necessary to:

Provide support

Comply with legal obligations
We do not sell personal information to third parties.
19. Electronic Communications
By placing an order, you consent to receiving transactional communications via email.
You may opt out of marketing communications at any time.
20. Security and Data Protection
While we implement reasonable technical and organisational security measures, we cannot guarantee that the Site will be free from security breaches.
You are responsible for maintaining secure internal IT environments when deploying cybersecurity products.
21. Governing Law
These Terms are governed by the laws of:
Queensland (QLD), Australia
Any disputes are subject to the exclusive jurisdiction of the courts of the QLD.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
23. Entire Agreement
These Terms constitute the entire agreement between you and Forti SecureStore regarding use of the Site and purchases made through it.
